Complete recommendations : report of the Committee of Secretaries

Readers may access and download the complete recommendations of the Committee of Secretaries by clicking here. Though most of the important issues have already been amplified in earlier posts, some other recommendations are :

(a) Like defence personnel, linkage of full pension with 33 years’ service also to be removed for civilians who retired between 01 January 2006 and 31 August 2008.

(b) Broad-banding of disability percentage would be extended to pre-1996 pensioners too. It may be recalled that the 5th Pay Commission, in order to curtail medical subjectivity of medical boards, had recommended that personnel with a disability percentage below 50% may be released a disability element by taking the disability @ 50%, those with 50%-75% disability may be paid @ 75% and those with a disability percentage of over 76% may be paid by taking the disability as 100%. This was accepted by the Govt in 2001 but was made applicable only to post-96 pensioners. The Hon’ble Punjab & Haryana High Court had however held that this dispensation should be extended to pre-96 disability pensioners too but the said decision was challenged by the Govt in the Hon’ble Supreme Court.

(c) Removal of the cap on war-injury pension (known as Disability pension of Category E in case of civilians) to be extended to personnel of civilian forces too.

IT IS NOT CLEAR WHETHER MSP AND GRADE PAY WILL BE ADDED TO CORRESPONDING NOTIONAL REVISED PAY FOR CALCULATION OF PENSION FOR PRE-2006 PENSIONERS. I THINK 33 YEARS LINKAGE FOR FULL PENSION IS ALSO NOT REMOVED. GOVT HAVE NOT DONE ANYTHING FOR RESTORATION OF PENSIONARY WEIGHTAGE AND MAXIMUM OF PAY SCALE FORMULA FOR PBORS

Does the post regarding disability pension imply that ESM in receipt of disability pension like 20%/30% can expect to receive 50% as disability pension? I had sought clarification on the subject from PCDA Allahabad and I was advised that the rule was not applicable to persons retiring with pension but only to those who were boarded out on medical grounds. What is the correct position?

YES YOU ARE RIGHT. IT WILL BE APPLICABLE TO THOSE WHO ARE MEDICALLY BOARDED OUT AND NOT NORMAL DISCHARGE WITH DISABILITY PENSION.

On the contrary, the Hon'ble High Court has already held that it would be equally applicable even to personnel who have been discharged / released / retired with a disability pension on completion of terms / superannuation.

The decision of court is not being implemented by the Govt/PCDA(Pension).Can you please provide a copy of the court order so that PCDA Pension could be approached. Thanks.

If MSP and grade pay are not considered for arriving notional revised pay for calculation of pension for pre-2006 pensioners,there will not be much benefit particulary for those from X and Y group.

r/sir i was board out with 100% disability in 1990. now it is 30%.will these order be applicable on e. my medical review is in jan2010 .if these rules apply then i should not go for review is it so pls tell me. my disability is also not revised as per 6th pc. what should i do.pls guide me.thanks

Sir,
Reference: MODIFIED ASSURED CAREER PROGRESSION SCHEME (MACPS) FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES.
A close scrutiny reveals that our PBOR have been shorted in such a scheme too that, by giving them 8,16,24 yrs, it appears attactive; however, actually it is not so?

Our OR have three grade pays whereas Civilians have only one grade pay in the corresponding PB; similarly our JCOs have three grade pays whereas Civilians have only one grade pay in the corresponding PB.
Resultingly, our PBOR do not even reach JCOs pay after three ACP while civilians reach Gp A grade pay after three ACPs.
And after all this we seek equivalance of some kind???
Could you pl illustrate the same with some statistics for benefit our esteemed lot and a suitable case to be taken up by our rank bearers.

are the recomendations of cos has been accepted by govt or not. in your erlier article it was said that dispense of 33yrs service with 20 yrs not sanctioned whereas cos has recommened this, so my kind request is that whether this recommendations has been fully accepted by govt or not, Navdeep sir is requested for his openions on this issue.

Ref Para 8 (v) of this recommendation. Out of the 4000 offrs estimated to get benefitted by this, how many of them are Lt Gen and equivalents from Navy & AirForce? 100,200 or 300? Then why at 9(c) they have mentioned Lt Gen? It should have been addl secy and equivalent, no? They are gaining the benefits and make it appear as if Armed Forces (Lt Gen )are getting benefitted.. Continuing with the dirty tricks..... Yet again???

Thanks for your clarification of 23 rd that retired pensioners are also entitled to broadbanding of disability pension in terms of the orders of the Supreme Court. Could you please provide a link on this page so that all those affected may download the orders and take up with relevant authorities viz. pcda/afao/cdan.

Is there a letter indicating that Report of Committee of Secretaries has been approved by Govt for implementation? CDA Pension rigt now is not giving Pension @50% of pay to Officers retiring before 01 Seo 2008.

Respected Sir,

Referring to your answer to Col Nagar dated August 23, 2009 5:05 PM on the issue of disability pension for his request for a copy of the court order so that PCDA (Pension) could be approached where you had said that "You may please email me for the same."

I am serving in Indian Navy and retiring in Nov 09 after serving 20 years for my country . During the Release Medical Board (RMB), I have been awarded 20% disability pension.

However in the past i.e. when my senior courses retired in the last year they were only given actual disability pension i.e. 20% for 20% disability not 50% as you had mentioned as per the court order.

May I please ask you that what pro-active action I could take in this situation as I am sure I may be also given the same 20 % disability pension against 50%.

I further request you for following help :-

(a) A copy of the said court order.
(b) How should I go-ahead in this situation when I am about to retire, protecting my vested interest in advance against going to PCDA(Pension) for resolving the issue as Col Nagar sir will be doing.

Just been eagerly waiting to know about the abolition of linkage of 33 yrs service to obtain full 50 % pension as recommended by COS for retirees between 01 Jan 06 and 02 Sep 2008. We would be very grateful to know the progress on the matter especially a miniscule who are affected eventhough they may be in minority..Hope you would be throw some light on the matter...Waiting for your comments

Can you kindly post regarding the acceptance of COS recommendations by the government by now. PM also announced on Aug/15, that the pension of defence personnel are likely to raise further. When it will be likely to be implemented.
