Such cadets in all military academies are entitled to only Rs 1275/- per month as a disability ex-gratia (likely to be notified @ Rs 3500/- per month soon). Moreover this amount is not categorised as ‘disability pension’ and such cadets are not entitled to the status of ‘ex-serviceman’, ECHS or any other military facility which is granted to retired or released officers.
On the other hand, a recruit who may get injured on the first day of training is entitled to proper ‘disability pension’ alongwith the status of ‘ex-serviceman’, ECHS and all facilities that are available to released Jawans.
A hypothetical comparison of an officer cadet and a recruit for 100 % disability is as follows :

ReplyDeleteRegards. Could you, please, enlighten me as to who gets the Constant Attendance Allowance. As far as my knowedge goes, only ( R) only 100% disabled soldier is entitled for Contant Allowance and not every disabled soldier. You are also requestested to clarify how much is the minimum service element with the such cases of disability.
A Recruit starts his Colour Service the day he becomes a recruit, whereas an Officer Cadet starts his service only after he gets commissioned. This is in contrast to civil services where the period of training is included in service for pay and promotions. This anomaly needs to be addressed first. The rest will follow.

It is good to see that you have good knowledge about officer rank benefits.
I give one more comparison about other ranks & officer rank. An officer gets his Lt. Col Rank in 13 years and upgraded in PB4. Whereas Sep gets his Hav rank in minimum 13-14 years and remain in PB1 with tradesman for next 10- 12 years. In case IAF/Navy may be full remaining service. Is it justified?
The only way to correct this anomaly is to call the gentleman cadets(GC)as officer cadets during trg but on paper they should be as commissioned offrs as in the case of tech grad entry.As it is they are drawing the pay of Lt during trg.Also the trg period should be counted for promotion / pension for all purposes.On commission they should get GP of 6100/-.This is a gross disparity and should be taken up for resolution by Services HQ.There would not be very many cases but it is unfair.

This can only be resolved aftwer the change in the status of cadets training period.
in iaf, met and engg officers are taken in as officers from day one. i believe that matter of taking all cadets as officers was taken up by service headquarters but was shot down at ministry level.

ReplyDeleteThank you for raising an issue which will reveal the mother of all anomalies. As many patrons have already pointed out, the anomaly lies in the fact that the date of seniority of an officer commences wef the date of commission and not from the date of joining for training. However, fixing date of joining for training as date of seniority may not solve the issue. We have so many different types of entries.. NDA,Direct,TGC,10+2 Tech,UES and so on. Some get trained for 1.5 years, while some other only for 9 months. Some get ante-date seniority for even their duration in a college/university. Some can serve only as short-service and get a seniority loss while opting for permanent commission.While I fully agree that, training period should be counted for seniority just like any other Group A services, these issues of duration of training also is required to be addressed.

ReplyDelete(1) recruit gets paid from the day he joins service whereas cadet gets paid only on completion of 3 yrs cadet training at NDA n equivalent academies.
(2) service of recruit is counted towards pension from the day he joins service where as for officers, initial 4 yrs of Cadet/gentleman cadet/air cadet/sea cadet is not counted towards pensionable service
(3) cadets don't get a permanent I card whereas recruits get
(4) cadets cannot avail facilities for dependents like Form D(railway concessions), canteen facilities etc.,
further regular entry cadet(NDA) enters into a bond for pmt commission as a minor prior to joining academy. bond is also signed by the parent before cadet joins academy. what is the locus standi of such bond which is executed with a minor. further can the parent of a minor execute a bond for his child which will bond him for his entire life? if some oficer wants to resign on the above pretext, can't he do so?

ReplyDeleteAs far as pay is concerned a Genleman cadetis getting stipend during training period and on successful training when He is commisioned, he gets the difference in full pay of a Lt. as arrears. There shall be no extra outlay from the exchequire then what is the hitch. To be frank the problem is our beurocracy. Due to addition in service by two years to the seniority of service officers the edge enjoid by the beurocrats may disappear. So who cares if the defficieny in officers of Armed Forces is inceasing every month. They may wake up if another 1962 happens but not otherwise. MERA BHARAT MAHAN. JAI HIND . I D

When passing out of IMA in the Dec Batch. The newly commissioned Officer gets around 21 days leave before joining his new Regiment. This leave is counted towards the next years leave, while it has started in the previous year. I wonder why?

ReplyDeleteNavdeep/Navjosh has already clarified that the figures are for offrs/recruits with 100% disability. Yes CAA is only applicable to 100% disabled pers.
Secondly those who have stated that offr cadets are not at par with recruits as far as being on roll of the org is concerned. Let me remind you that all offr cadets are entitled to full back wages based on proper scale of a Lieut with retrospective effect once they pass out. And Naval offr cadets are under the Navy Act even durign the time they remain cadets.
Absolutely important issue raised by navdeep, hope people are listening.

Very rightful and an issue of grave concern brought out by Maj Navjosh.i'm an ex-GC of OTA boarded out on medical grounds in 2006.After much struggle now i'm in receipt of disability pension and after 1 year of numerous visits to Sainilk kalyan board i got my ex-serviceman i -card.the root cause is the process is not laid out and one has to fight for it.we have to sort it out. All boarded out cadets have to come together and fight for justice.

And though the order is out for the raise of this ex-gratia ,God only knows how much we have to run after the accountants and clerks of pcda .

ReplyDeleteI am an ex jag officer from navy. i have filed a case in principal bench aft on behalf of some retired naval officers saying that the cadet time period should be counted as qualifying service for pensionary purposes.
ReplyDeleteA long struggle is ahead of us. i came into the picture pretty very late by which time the damage was already done. Nevertheless, we must fight on.
this is a good cause where the clauses contained in the pension regulations stipulating that only commissioned service will count as qualifying service can be declared as unconstitutional. If that happens, a lot of issues will get resolved by itself.
any naval officer with retired with about 17 years of service is a good candidate to challenge this stipulation.
Hope it gets done soon.

ReplyDeleteone thing i would like to inform all of u that ex-gratia per month given to boarded out cadet is 3500 pm . this amt is fixed as per sixth pay commission that minimum pension of any person cannot be less than 3500. This amt is basically fixed to sweeper , safiawala on their retirement as there pension. as ex-gratia award is nothing but a synonymus word used in place of pension the amt fixed is equivalent to safiawala and sweeper of central govt emp. so one could imagine how rudely this amt has been fixed and they have treated an excadet equivalent to sweeper. for proper fixation of amt of ex gratia cadets have to move to CAT court for redressel of their claim

ReplyDeleteI was medically boarded out from OTA (SSC-70) with 30% disability in 2000. I get disability pension as well as Ex gratia which is meager.
Recently I had applied for the ECHS facility on the grounds that the Gentleman Cadet comes in the category of an officer (it is clearly mentioned in the application form which depicts the ranks of the Officers as well as the other ranks, starting with Gentleman cadet at the base and which goes up to General. On this basis I was issued with a Temporary ECHS Card from the local polyclinic, ie 61 Sub Area. I was also instructed to pay 60,000/- which is now the one time fees applicable for officers (which was earlier 18000/-), which I have paid. (MRO 573440/17 dt- 17.08.11.
Now I have recd a letter from the Regional CGHS that this temp Card has been revoked and I need to return back the same to the Polyclinic 61 Sub Area with immediate effect. The letter also says that Ex GC's are not eligible for the ECHS facility. If so, why is it mentioned in the form. Kindly enlighten me.

ReplyDeletefor pension is 50 % of basic + grade pay last drawn. therefore the minimum basic is 5200 rs and minimum grade pay is 1800 which becomes 7000 and the 50 % of is 3500. which is the minimum pension that can be given to any person . this has been taken as basis and the ex-gratia has been fixed to 3500. where as the cadet on commissioning is on grade pay of 5400. so the ex-gratia should also be fixed as per 5400 grade pay not 1800 grade pay which is anomaly

present ex-grtia 3500 p.m is not applicable to us it is for the goup D employee
the basic of Lt is 15600 + 5400 GP total amount rs 21000. so as per set up rules 50% of the last pay drawn + GP becomes 10,500. this is what should be the ex-gratia P.M to a cadet . govt has treated ex-cadet like a group d employee

A correction to above for Pallavi, a GC is considered an ESM for employment purposes and is given priority 1 in ESM catagory reservation for Civil Services. This is also applicable to state civil services. I am unable to refer this to a MOD or GOI notification in this regard, however I trust there has been such a notification issued by MOD/ related GOI dept. Can someone throw some light on this please?

here's a lok sabha order, "Recruits/Officer Cadets who are medically boarded out due to attributable causes be given the eligibility for employment assistance through ex-servicemen reservations and self-employment facilities by the issue of suitable administrative instructions. They however, need not be categorised as ex-servicemen.
Action Taken: The recommendation was referred to the Department of Personnel & Training. The Department have issued necessary orders vide their Office Memorandum No. 14024/3/95-Estt. (D) dated 4.6.1996,

ReplyDeletethere is a new twist after the release of new definition of ex-servicemen released recently vide Notification dated 4th Oct 2012 issued from Ministry of personal, Public grivance and pension, in which they have added Ex-recruit at row no 6 and granted ex-servicemen status for all pupose to those cadets boarded out on medical ground and in receipt of disablity pension. This time too they left the Ex-cadet on mercy of god. Moreover, the new notification has enabled the ex-servicemen to apply for all category i.e group A, B, C, and D services. earlier it was restricted to c and D only. the new notification on one hand has given relief to ex-recruit on other hand left Ex-cadet with empty hand. as both are trainees and both are boarded out on same ground there is huge disparity b/w them. On one hand rounding of disablity benefit is given to ex-recruit on other hand same is denied to ex-cadet. clear voilation of constitution.

ReplyDeleteI got boarded out from IMA with 20% disability. They sent me some kind of letter for ex-gratia payment for 2 years in July last year, but nothing has happened since then. Firstly what do I do about the ex-gratia...(it doesn't say anything about a pension) Also, am I eligible for any other benefit such as ECHS card, canteen facilities etc? Thanks

ReplyDeletei would like to inform u that u would have received one page form for filling and to be send to IMA. The paper from IMA is forwarded to Command Hospital and then the same is forwarded to MT-6 New Delhi. Till this stage every thing runs smooth and it takes only three to 4 months time. The MT-6 at Delhi sends the paper to PCDA Allahabad. Most of the time the paper is not traced in Allahabad and U will keep waiting. The same case had happened to me also. So, I will recommend you to first contact the MT-6 Delhi whether they have received your paper of not then only other things can happen. any further help if needed from me then contact to me on my no 9408530534 after 7 PM or before 8.30 am i will help u

I am an ex cadet from NDA boarded out on medical grounds in 2008. I have my CSD Card made and am in receipt of my ex gratia. Would like to know if my CSD facilities are extended to AFD items like cars?

ReplyDeleteI joined IMA on 12th July 2007 and was boarded out on 4th Feb 2009. They gave me 30% disability for ex-gratia with disability pension. Kindly explain whether I am eligible for ex-servicemen? Whereas, I have seen an order stating that recruits are being given the said status!

Good Evening to all,
ReplyDeleteI got boarded out 2 years back, however fight my way out to deal with the authorities to get my rightful claim I got so involved that never took out time to find out if there are others too who are sailing in the same boat. But as they say better late then never.
I refined my search on google and landed on this page. I am happy to see that there are others too who are also triggered like me coz of the arbitrary action of the whole set up.
I belong to a family where two generations have already served the armed forces and I was quite charged up, thrilled and motivated to represent the third generation in the olive greens, to the extent that I left my law degree midway to wear the uniform.
It was unfortunate that after sustaining an injury during and fighting the odds for quite some time I had to accept the opinions of the army doctors.
Having studied law, from the very beginning I used to find it discriminatory that a person joining as recruit shall be under the army act however the one who makes his way through a an exam conducted by the UPSC and the most extensive and detailed interview in any of the government services, is left to deal with his fate. This is when the armed forces believes in the principle that 'no men shall be left behind.'
After coming back other than getting my Ex-gratia claim, and apprising the concerned authorities about the way it has to be computed, I finished my law degree and have started practicing at the High Court of Delhi.
Having detailed research pursuant to the various authorities and notification and also the constitution validity of the same I am planning to pursue the matter at hand and if need be initiate appropriate legal proceedings in this regards.
Fortunately my father after having served the army for good thirty years have been actively practicing law and I am quite certain that he shall be there to guide me in the best possible manner.

ReplyDeleteRecently the MoD has forwarded the representation of Ex-GC Mohit Verma to HRD (Co-ordination). Ex-GC Mohit verma in his representation to the Defence Miister has highlighted the issue of disparity b/w officer cadet and recuruits boarded out on medical ground and how an officer cadet is devoid of all the facility like ESM facility, ECHS and Disability Pension. I could not understand why the Under Secreatory of MoD transferred the case citing it as policy matter to the HRD ministry , Under Secretary HRD (Co-ordination) can u throw some light on this issue

Hi ankur,
ReplyDeleteMedically boarded out cadets don't get pension, they only get ex gratia award depending on the disability percentage. For other things we are trying to figure out ways to get it from the government. We have a group of cadets in whatsapp. You r welcome to join...you will meet lot of your seniors there...

i think there has been some developments wrt disability pension being given to ex cadets after orop...some update pls
ReplyDeleteCadets are not eligible for OROP or disability pension. reasons has been discussed above need not to emphasize. It is. irony that even though 6th CPC made qualifying service as NIL for earning service element under disability pension and 50% of last drawn emoluments was to treated as service element, further continuation of ExGratia Award policy was obsolete and needed to be replaced by disability pension. Training whether counted or not counted as qualifying service for pensionary benefit has become irrelevant for cadets if rules of 6th CPC for disability pension is implemented in letter and spirits

ReplyDeleteIf a cadet is invalidated till 31st dec 2015 his eligibility for all benefits will be based on 6th CPC existing rules subject to upgradation of benefits as per 7th cpc

ReplyDelete30. Though not pleaded in the writ petition, but since it is to the
knowledge of this Court and the existence of which was not denied by
learned counsel for the respondents, on January 31, 2001 the Government
of India, Ministry of Defence issued a office memorandum No. 1
(2)/1997/1/D(Pen-C). The subject of the policy circular is the
implementation of the decision by the Government concerning disability
pension to members of the Armed Forces and as per the same any disability
above 20% upto 50% has to be treated as a disability of 50% and thus we
declare that in conformity therewith the petitioner would be entitled to the
benefit of disability at 50%. The policy circular clearly states that it would
be applicable with effect from January 01, 1996 i.e. has a retrospective
operation. But this is irrelevant in the facts of the instant case because the
petitioner was invalided as a trainee on March 18, 2008 and the benefit
which the petitioner receives as a result of our opinion would be with effect
from the date of the order of termination i.e. March 18, 2008.
31. The writ petition is accordingly disposed of directing the respondents
to pay the ex-gratia amount at the rate contemplated by the first limb of the
policy circular dated April 16, 1996 as also and additional disability award
on ex-gratia basis at the rate contemplated by the second limb of the same
policy circular and while doing so to give effect to the Government of India
memorandum dated January 31, 2001 i.e. notwithstanding the disability
being assessed 20%, to grant the same by treating the disability at 50%.
32. Interest shall be paid @ 6% per annum on simple interest basis
reckoned from each month when the amounts were payable till disbursement
takes place and we are granting interest for the past sums payable because
the respondents have taken a patently illegal stand as also have indulged in
interpolating the record.
33. The petitioner shall be entitled to costs which we quantify at
`25,000/-. The same shall be paid by the Union of India.
