Majors who attained 21 years of service after 1-1-96 were to be automatically granted the scale of Lt Col

There were many substantive Majors who could not be promoted to the time scale rank of Lt Col for the reason that they did not fulfil the promotion criterion at the time. Besides other cases, this also included certain officers who were medically downgraded in some specific medical categories.

Not many know that the Special Army Instruction 2/S/98 (applicable with effect from 01-01-1996 till 31-12-2005) provided that all those officers who stood promoted to the rank of substantive Major prior to 01-01-1996 were to be granted the pay scale of Lt Col with the rank pay of Major on completion of 21 years of commissioned service as a one-time measure.

The above was to be undertaken suo-moto by the authorities concerned but the same it seems was not done in all cases.

Hence the above may please be pursued with the concerned agencies if anyone happens to be affected by the said stipulation. In short, all officers who were Majors as on 01-01-1996 were supposed to be granted the scale of Lt Col on completion of 21 years of commissioned service.

Please apply for the above revision if the above is attracted. The authority for the same is Para 5 (a) (iv) of SAI 2/S/98. This shall have a cascading effect on the pensions of all such officers in the current 6th CPC era too.

Good info.If this is persued the current gap between the pension of majors/Lt col will automatically gets reduced and the problem gets addressed.

Subject:- Payment of Dearness Allowance to Central Government Employees - Revised Rates effective from 1.1.2010.


The undersigned is directed to refer to this Ministry's Office Memorandum No.1(6)/2009-E-II(B)dated 18th September, 2009 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced form the existing rate of 27% to 35% with effect from 1st January, 2010.


2. The provisions contained in paras 3, 4 and 5 of this Ministry's O.M. No.1(3)/2008-E-II (B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.


3. The additional instalment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.


4. The payment of arrears of Dearness Allowance for the month of January and February, 2010 shall not be made before the date of disbursement of salary for March, 2010.


5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.


6. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Audit General of India.

I would like to share an important piece of info which should be of interest to offrs who retired between 1.1.96 and 31.12.2005 in the rank of Maj or Lt Col (TS)
As rightly brought out, the pay scale of Lt Col (S)/Lt Col(TS) and substantive Major with more than 21 years of service as on 1.1.96 are one and the same. The only difference being, the rank pay of Lt Col (TS) and Maj is Rs 1200, which is less than the rank pay of Lt Col (S).
The weightage to be added to the qualifying service for pension is 5 years for Lt Col(TS) and 8 years for Maj. There is however a rider that the retiring pension of Lt Col(TS) shall not be less than the pension that would have been admissible to him had he not been promoted to the higher rank.
I took premature retirement in the rank of Lt Col(TS) with 23 years of service, as on 20 Oct 1996. As I didn't have 33 years of service for full pension, my pension was computed for 23+5 years on pro-rata basis. But this was less than the pension I would have got as a Major, had I not been promoted to the rank of Lt Col (TS), because of two reasons:
The pay scales of Lt Col (TS) and Subs Major with more than 21 yrs service, one and the same. But the weightage allowed to Major is 8 years while, for some strange reason, it is 5 years for Lt Col(TS). I took up the matter with PCDA pension to fix my pension by adding 8 years weightage instead of 5 years weightage applicable to Lt Col (TS). It took me almost 10 years and invoking of RTI to get my pension reviewed and refixed with the pay scale of Lt Col (TS) and 8 years of weightage as applicable to Major. I therefore request all Lt Cols(TS) to pl check if your pension has been worked out by adding 8 yrs to your qualifying service (If you have less than 33 yrs service for pension).

Angry court joins battle

The Supreme Court has slammed the government for treating army personnel “bravely defending the country even at the cost of their lives” shabbily and upheld a higher disability pension to an officer who lost his hand in the Siachen.

“This is a pittance (Rs 1,000 a month, plus dearness allowance). If this is the manner in which the army personnel are treated, it is extremely unfortunate…. We regret to say army officers and armymen in our country are being treated in a shabby manner by the government,” Justices Markandey Katju and A.K. Patnaik said.

The government had appealed a Punjab and Haryana High Court order giving C.S. Sidhua higher pension.

...“… We are in full agreement with the high court that for the purpose of qualifying service for disability pension, the entire period of commissioned service rendered by the respondent has to be taken into account,” it said....

Wg Cdr S Govindarjan - etinCDA does not issue any letter showing the calculation regarding fixing of pension and commutation of pension. Is it not obligatory on their part to send a copy of the calculation to the person concerned. Is it possible to obtain the same through RTI?
