Revised letter on casualty / disability / war-injury pensionary awards for pre-2006 retirees based on 6th CPC scales issued

As reported here earlier, the letter on modified parity for casualty awards has finally been issued. Casualty awards from now onwards are to be calculated based on 6th CPC scales.

The letter can be accessed and downloaded by clicking here. Please do not mail me individual requests for the same, such requests shall not be replied to.

In brief, this shall be the fresh entitlement with effect from 01-01-2006 :

Special Family Pension : Would not be less than 60% of minimum of 6th CPC pay band + Grade Pay + Military Service Pay + X Group Pay (wherever applicable) corresponding to the rank held.

Liberalized Family Pension : Would not be less than the (100% of) minimum of 6th CPC pay band + Grade Pay + Military Service Pay + X Group Pay (wherever applicable).

Disability Element : Would not be less than 30% of the minimum of 6th CPC pay band + Grade Pay + Military Service Pay + X Group Pay (wherever applicable) for 100% disability, proportionately reduced for lesser disability.

War Injury Element : Would not be less than 60% of the minimum of 6th CPC pay band + Grade Pay + Military Service Pay + X Group Pay (wherever applicable) for 100% disability proportionately reduced for lesser disability in cases of retirement / discharge and 100% of the minimum of 6th CPC pay band + Grade Pay + Military Service Pay + X Group Pay (wherever applicable) for 100% disability proportionately reduced for lesser disability in cases of invalidment.

Thanks for posting the much awaited letter.
Thanks to department of ESM too.They have taken just four and a half months only to issue these orders after the OM for civilians was issued. State of affairs is really
POOR. Any way, better late than never.
If possible, may you throw some light
on the condition of minimum limit of 7000 pm mentioned at para 9.2 ?
Is it applicable only for personnel with more than 60% disability ?

Thank u for publishing the long awaited order. Unlike circular 282, tables are not prepared. (I do not know, the CDA(P) may prepare any tables) It will be very difficult to get the correct pension by the families. Thanks to RBI for recommending payment of compensation for delayed payment of pension arrears. I hope the Banks will wake up atleast now.

Dear Sir,
Though the information is welcomed, there is downward trend for Disability pensioner. For Example:

A Sepoy of 'Y' Group - Min Pay in the Pay ban is 5200 + Gp-2000+Msp 2000=9200
Disability 1005 will be 3
0% of 9200=2760
The present Rate is =3510 as per CdA cir 410.
Please clarify.
Likewise War injury also going down.
Same method - Foe Sep- 60% works out to be 5520 whereas it now 7020.
Kindly Look in to this disparity.

No need to worry.
If the amount is higher under the old system, then that shall stay protected.

In any case, the govt has already notified that the amount of disability element shall not be lower than Rs 3500 per month for 100% disability for any rank.

May any reader advise on the pension
entitlement of a widow / spouse of an army disability pensioner, who retired on superannuation with some percentage of disability and getting normal service pension as well as disability element of pension ?
Are the pension entitlement of the spouse / widow only as under -
1. Enhanced rate of family pension
( upto the date on which the
officer would have been 67 years
of age)...current rate ?
2. Subsequent to enhanced rate of family pension, ordinary rate of family pension @ 30% of total of minimum of pay band + MSP + GP
Are there any provisions for grant of better familiy pension,considering decrease in life expectancy of the officer due to the disability ?

Please refer your comment at 7:32 am.
Kindly confirm if the minimum limit of 3500 pm is applicable for all ranks and for disability element alone ( Not to be combined with service element)?
As a Lt Col ( pre 1-1-06 retired) with 20% disability, my disability element works out to be only 3084 pm being 20% of 30% of 51400 ...(37400+8000+6000)
Will I be getting 3500 pm as disability element in addition to my service element of pension ?

I also am of the view that for all pre 1-1-06 pensioners ( including family and disability etc) ,the "minimum of pay band" MUST be replaced with " minimum pay for the rank from which retired".
Also Enhanced rate of family pension should be equal to 100% of the service pension of the deceased.
Family pension ( in case of disability pensioners) should have some percentage of disability pension also ; as any kind of ailment is likely to decrease the life of the pensioners to some extent . I suggest it could be normal family pension + 50% of the disability pension of the deceased.

2. Your disability pension should be 50% of the above value.

Any disability of any nature is bound to affect the life expectancy to an extent.
Therefore the families should also be granted some compensation for the disability of the service pensioners.
It could be to the extent of at least 50% of disability element ,that the deceased soldier was getting .

Generally speaking, Enhanced Rate(of Ordinary Family Pension) would be half of Liberalised Family Pension.
In both cases, the Reckonable Emoluments contain an element called the Last Drawn Pay.
But the definition/interpretation of the term, of Last Drawn Pay has undergone a change( for all those who retired prior to 01/01/2006), post 01/01/2006. As per the new definition,it is the minimum of the 6th CPC Pay Band in which, pay of the officer would fall.
One rider to the quantum to the Enhaned Rate is, that it would be limited to the amount equal to Retiring Pension or Retiring/ Invalid/ Service Element of Disability Pension

Thus the Enhanced Rate of ( Ordinary Family Pension) would be 50% of (the minimum of 6th CPC pay band + Grade Pay + Military Service Pay + X Group Pay ,wherever applicable), for pensioners of Pre 2006 vintage.

See below, for explanation of the terms:-

[Enhanced Rate of Ordinary Family Pension:-
Enhanced Rate - Where on officer dies while in service having rendered not less than 7 years continuous qualifying service, or who dies after retirement with pension. Ordinary family pension at enhanced rate shall be granted for a period of 7 years or upto the date on which the deceased would have attained the age of 65/67 years. The amount of enhanced rate shall be the lowest of the following amounts:
a)50% of the reckonable emoluments.
b)amount of retiring/ invalid/ service element of disability pension.
For this purpose, reckonable emoluments comprises of pay including Rank Pay, stagnation increments and NPA, if any, last drawn.]

[Liberalised Family Pension:-
In case of an officer under the circumstances mentioned in category ‘D’ or ‘E’ eligible members of the family shall be entitled to liberalised family pension equal to Reckonable emoluments last drawn.
Reckonable emoluments includes pay, rank pay, NPA and stagnation increments, if any, last drawn.
As per MOd Letter, No.17(4)2008(1)/D(Pen/Policy)/-Vol- V dated 15 Feb 2011 cited by Maj Navdeep,
Liberalized Family Pension : Would not be less than the (100% of) minimum of 6th CPC pay band + Grade Pay + Military Service Pay + X Group Pay ,wherever applicable.
Note. This way computing family pension does not incorporate the ( more beneficial) principles enunciated in PCDA(P) Circular No. 430 Dated 10/03/2010 and MOD Letter No. PC 10(1)/2009-D (Pen/Pol),Dated 8th March 2010, for computing of Service Pension/Service Element].

I am a pre 1-1-06 retired Lt Colonel.
PCDA(P) has fixed Enhanced rate of OFP as per 2.26 times of Pay + rank pay last drawn as per 5th CPC. and OFP as 15420 pm
As per Penmil's comment and as also given in AG'S br pamphlet,it should be lowest of the two-
1. Reckonable emoluments
2. Retiring service element of pension.
I think reckonable emoluments carry no meaning for all pre 1-1-06 retirees now (wef 1-1-06)
Retiring service element of pension for pre 1-1-06 retired Lt Col has to be minimum 25700 pm.
Therefore should the enhanced rate of OFP now be 25700 pm.
May any reader clarify the position with authority .

So what should be the special family pension of a mother of a sepoy? Should it be Rs.3500 or Rs.7000?? Because as per this circular the special family pension of a dependent of sepoy should be 3500

Thank you very much for the very uplifting post.Before going further Imust say that you and your blog is a blessinng to us.
The Govt have now granted the benefit of calculation of disability pension on perccentage basis as opposed to the existing slab system wef 1-1-2006 to all Defence disability pensioners who were discharged/retired on completion of terms of engagement/superannuation.They have, however,not granted the more beneficial method of rounding off/broadbanding of the disability percentages.This has been granted,through an earlier order,only to the 'ínvalided out'Defence disability pensioners. Compare this to the fact that the percentage system was introduced for the civil disability pensioners since the Vth CPC.Rounding off/broadbanding of disability percentages was granted to all the civil disability pensioners in 2001, if Iam not wrong. Defence disability pensioners who were/ are discharged/superannuted on completion of the terms of engagement continue to be shortchanged.
However, Regulation(para 179 and 53 ?)provide that Defence personnel in Low Medical Category at the time of retirement are also 'deemed' to be 'invalided out' for the purpose of disability pension (I have relied on your earlier posts).This has been upheld by the Hon'ble High Court also.Hence, there is no room for a class distinction between 'Ínvalided Out' and 'Discharged/Superannuated' personnel. Thus the Govt's action not granting the benefit of rounding off/broadbanding of disability percentages to Defence disability pensioners discharged/superannuated from service is arbitrary and flawed.Also,as compared to the civil disability pensioners, the Defence disability pensioners who are discharged/superannuated are still at a great financial disadvantage.
The affected Defence disability pensioners will greatly appreciate if you could give this anomaly/inequity some attention and suggest if a remedy is available/possible. Your views will be invaluable.

My enhanced rate of OFP has been fixed/revised some times in Dec 2010.
The new rate is 2.26 times of my pre 1-1-06 service pension ( basic pension only)
OR it may be said to be 50% of 2.26 times of average emoluments of last 10 months of service.
This is certainly NOT equal to revised service pension.

Thanks for educating us on the subject.Considering that although civilians have been given disability benefits much earliar, but at last we defence personnel too have been brought at par though a little late. These decisions could/ should have been taken much earliar, I am hopeful that BB case too will be resolved soon.Although i am deadly against BABUS taking unduly long time to decide cases but it appears they are getting around slowly and slowly to our way of thinking . ( Perhaps I am not talking too much too soon ) Hope for the best .

Thanks a lot for this effort of yours for keeping the ESM informed of the various updates.

With reference to ths letter I had two queries:

1. If the minimum in the pay band is considered then it means that the pension of a Lieutenant and that of a Brigadier is the same (apart from the difference due to the grade pay) as both fall in the same pay band. I understand that this issue has been raised by few in the blog.

2. Would the dearness Relief be applicable on the complete pension (Service element + war injury element), wef 1.1.2006?

I would be grateful if you could throw some light on the above. Thanks once again for every little update you bring to notice.

@ Capt Sameer, I clarify. Point one- PB 3 is for Lt to Maj, for Lt Col PB 3/4 as applicable, PB 4 for Col to Maj Gen. Reference to SAI 2/S/2008. Point Two - DA is calculated on both elements of disability. U may refer to PCDA Circular 282 Note (V) 6. From Col Ajit Singh

Thank you Sir for the clarifications. I had missed out the SAI completely. I would like to ask one more query. Since the PB 3 is from Lt to Maj, so would there be any difference in calculation of pension for a Lt and say a Major? The reason for asking this query is that if I have to find mine, then since I was in the Rs 9600-300-11400 (pre 2006 pay band), so would the pension of a captain be calculated on Rs 15600 (minimum of the entire PB3 i.e 15600-39100) or Rs 17400 (i.e the stage in the revised PB; refer Table 2.3.1 of Report of 6th Pay commission dated march 2008)? I would really be grateful if you can throw some light on this.
Also Sir, would it be possible to get a copy of SAI-2-S-2008 because I searched on the net but it was available only to view and not to download.

After going thru the semi legal language of the The PCDA (P) Circular no 456 dated 18 MAR 2011,on the Disability Pension, I have a small doubt.I superannuated from the service after 33 yrs,with 40% Disability Pension,on 31 DEC 2003. As per the Tables 4, of the ibid circular,my Disability Pension should be,Rs. 20560/- pm.+ DA
Please confirm, if my calculations are correct /alternatively, what is my correct entilement?

1. Reckonabe emoluments for all gratuities and pensions was and continues to be basic pay + MSP + classification pay/allowance as per letters dated 30 Oct 1987, 03 Feb, 1998 and 12 Nov 2008.

2. However for determining minimum pension of pre 2006 retirees, only pay in pay band + GP + MSP + x factor where applicable is to be counted. The classification pay/allowance has been excluded. Kindly comment on this new rule position to determine the minimum pension under liberalized or for that matter any pension.

1. The classification allowance for ranks upto havildars has not been included in the reckonable emoluments thus depriving the pensioners/family pensioners from the element they were already getting in the past under fifth CPC
