The Hon'ble Punjab & Haryana High Court has issued a notice for contempt of its directions to the Secretary (Justice) in the Law Ministry and also the Defence Secretary for non-implementation of its directions in the case reported as Navdeep Singh Vs Union of India.

155Sir, As per 6th CPC, pension of Hony Commissioned Offrs (PB-3)was fixed at Rs 13500/- (Hony Lts) and Rs 13850/- (Hony Capts) wef 01.01.2006. Prior to 2006 Hony Commissioned Offrs pay scale was a fixed one i.e 10500/- (Lts) and Rs 10800/- (Capts). As per pay fixation formula of 6th CPC, the existing pay of these ranks was to be taken into account and it should be multiplied by 1.86+Grade Pay and Military Service Pay (MSP)to be added to it. Accordingly the maximum pension for the fixed scale Rs 10500/- and Rs 10800/- works out as Rs 15465/- and Rs 16145/- for Hony Lts and Capts respectively whereas they were fixed with a maximum pension of Rs 13500/- and Rs 13850/- only. Now vide MOD letter dt 17.01.2013 pension of Hony Lts and Capts has been correctly fixed at Rs 15465 and Rs 16145 for Lts and Capts respectively wef 24.09.2012. Since the Govt has accepted the anomaly to the original orders of 6th CPC in recent Delhi High Court judgement, it should have been affected retrospectively i.e 01.01.2006 rather than 24.09.2012. I came across a news in 'gconnect.in'that in Dec 2012 the General grade officers of BSF managed to get NFU implemented for themselves.If BSF officers can be recognised as Organised Gp'A' service why cant the Babus at MOD accept the armed forces officers as organised Gp 'A' cadre. I m given to understand that BSF officers are in receipt of para-M.S.Pay(4500/- PM)
