explaining the dubious stand of the officialdom in the case involving counting
of the element of Non-Practicing Allowance (NPA) in the pension of Central Govt
Doctors, factum of which became clear on perusing the decision of the Supreme Court
in KC Bajaj’s case.
After the decision in the above case, the Department of
Pension & Pensioners’ Welfare (DoPPW) duly complied with the decision and
issued instructions with regards to inclusion of NPA in the pension of Doctors
with effect from 01 Jan 1996 (5th Central Pay Commission) which was
a subject matter of the said litigation. When informed that the same logic also
applied to fixation of pension after the 6th Central Pay Commission,
the DoPPW, upholding its image of a progressive department, rose to the
occasion and has now resolved the anomaly in toto by extending the benefit to pension fixed with effect from 01
Jan 2006.
Of course, similar orders for 5th CPC as well
as the 6th CPC have not been issued till date for Military Doctors.

Whenever some notification issued by central govt it is meant for civilians only and defense forces and railways has to wait for separate notifications which at times take long time for its issue. I think Maj Navdeep should ponder over it and take up the issue at appropriate level of govt as well as legally.
The SC Judgement on Inclusion of Non Practising Allowance in the pension of doctors, should be implemented for Military Doctors too, in toto and soonest..

Doctors are thought to be lowly forms by higher commanders of Indarmy. I doubt if they will get either NPA for pension or DACP for pay and ACP. Reasons best known to all of us :-(
The MOD has always been slow to respond to such issues. They now have the excuse of being too pre-occupied with major issue of OROP. By the way Min of Railways has promptly acted and issued orders for payment NPA to retirees. In the meanwhile I sent letter to CGDA & PCDA asking for implementation of Min of Pensions letter of 14-10-2014 on the subject. CGDA replied after 6 weeks to say that they await directions of MOD as the initial letter applies to civilian doctors only.- Air Cmde SP Deshmukh.
it is indeed commendable the way u have embraced and steadfastly represented issues of military personnel interests.
U have understood the human angle problems very well. Please continue to raise and address issues which affect the armed forces. The views n issues r realistically tempered with your experiences of the civvy street so to say. Kudos on your perseverance.
Major Navdeep follows the ABCs.....Accuracy, Brevity, Clarity. But he shouldn't use sarcasm or irony because the effect is lost on many. Sign of the times and limited attention spans maybe to blame but I suspect the gems are lost on most who are now in the "what's in it for me"mentality. Sad.
Any likelihood of it being implemented for Army Doctors also ?
