Disability and War Injury pension enhanced based on the fitment of minimum of pay within pay-band rather than minimum of pay-band itself

Five months after similar orders were issued for civilians, the Ministry of Defence has enhanced the disability and war injury elements of disabled and war disabled defence pensioners based on the fitment of minimum of pay within the pay-band rather than the minimum of pay-band itself.

Of course, this benefit has been granted only with effect from 24 September 2012 and not from 01 January 2006 despite the fact that the Supreme Court has upheld judicial decisions granting the benefit of such enhancement in pensions of civil and military pensioners from 01 January 2006.

Much credit goes to Disabled War Veterans India (DIWAVE) for thoroughly following this through.

Dear Navdeep there is a petition in Punjab and Haryana high court challenging the broad banding of disability pension from 01 Jan 2015 and not from 01 Jan 2006 but where is the original letter issued by the govt for the information of veterans and for their views. Can you please upload that govt letter.

Great job by DIWAVE. Terrible to see that civilians got this 5 months before us. With such treatment to the forces, why some people still claim they love this country, beats me. A country that gives second rate treatment to those who die for it is simply a bad country.

the service pension of pre-2006 jco/or is not yet upgraded to the minimum guaranteed pension as applied in this provision.
will it not be a anamoly???
firstly the service pension should be upgraded to said modality.

AND WHY NOT FROM 01/01/2006....

ONE MORE PENDING ISSUE IS BROAD BANDING OF DISABILITY PENSION AS PER HONOURABLE SC VERDICT DATED 10 DEC 2014 TO DISABLED VETERANS WHO CAME ON RETIREMENT ON COMPLETION OF THEIR TERMS OF ENGAGEMENT.

You are doing Yeomen service by disseminating these judgements. I wish these could percolate down to the grassroots.

The Zila Sainik Boards in most places are so ineffective that it is easier to get a response from the DM then from the ZSB.

A detailed post by some learned person is required on the functioning of the Zila Sainik Boards...why are they not on the Internet as part of a unified national website under MoD duly supported by a mobile app?

Its a case worth taking up.

PCDA(P) circular is yet NOT seen on their website.
Similerly MOD does not seem to have issued any letter for changing the effective date of payment from 24-9-2012 to 1-1-2006
for minimum guaranteed pension as per fitment in the pay band ( and not on minimum of the pay band).
Hope the same are issued at an early date.

Banks / PDAs are unlikely to effect this letter and make payment to beneficiaries; unless PCDA(P) issues
circular on the subject.
If any one comes to know of the circular of PCDA(P); kindly post it so that those affected can be benefited.

The broad banding of disability pension for retired/superannuated ESM is still not implemented.The SC has issued their verdict on 10 Dec 2014. Is any SLP filed by the MOD, or what is the delay for issuing an implementation letter? It seems that the babus are playing some ugly things to delay the benefits to the eligible esm.

Navdeep, the veteran community is highly indebted to your good-self for your selfless service towards them for years. I have a pertinent question to ask you whether we can file a contempt petition against MOD or particular officers in SC for causing inordinate delay in implementation of judgements issued by the Honourable Court after several years of litigation by veteran. Many beneficiaries die in harness waiting for implementation of orders which is a great disservice to the nation. We can quote similar cases in which implementation was effected in favour of our civilians counterparts and not for retired uniformed personnel. The case of willful disobedience with malafied intention of the bureaucrats towards the uniformed fraternity would a fit case to be highlighted to whole of India as we all have suffered a lot of this apathy towards us from babus for decades.
