Final closure to the agony of pre-2006 pensioners: Universal orders issued today for revision of enhanced pension from 01-01-2006 rather than 24-09-2012


Following the decision of the Armed Forces Tribunal and the Central Administrative Tribunal, as upheld by a judgement of the Delhi High Court (which in turn was based upon a decision of the Punjab & Haryana High Court) and then endorsed by the Supreme Court, and further after various twists and turns, the Department of Pension and Pensioners’ Welfare (DoPPW) has finally issued universal orders regarding revision of pension of pre-2006 pensioners with effect from 01 Jan 2006 rather than 24 Sept 2012.

All affected pensioners (and not just litigants) shall now be eligible for arrears from 01-01-2006 till 23-09-2012.

A big thank you to all stalwarts who were at the forefront of this fight, including Mr V Natarajan, Lt Cdr Avtar Singh and members of the Bharat Pensioners Samaj.

Respected maj navdeep sir,thanks for the post,I still remember the joy with which you posted the dopt orders for disability PENSION rationalisation dt 20 Nov 14 and I also learned that you had to meet the hon.DM personally to get it published by desw after 6 months.So the question is how soon the desw republish this om?

  9. Maj.Navdeep sir.
    As per the order, 'the revised pension w.e.f. in no case, shall be lowcer than 50% of the sum of the pay scale from which the pensioner had retired.' Whereas, orders implemented for Defense are not in line with the Pay Commission orders or the Court orders.They have not considered the formula of minimum of 50% of present rank in respect of ORs.

  11. Many veterans who were not covered on 24.9.2012 ( since they were already paid on 1.7.2009). There is apprehension among such veterans not being covered by this order, are not sure unless the money is credited into the bank accounts.SC order also does not specify universal coverage but upholding orders of HCs.

  18. Thanks for this long awaited , great news for which you all deserve our sincere gratitude. Though the order clearly says pre 01-01-2006 retirees, lot of post 2006 veterans have a doubt whether this order has any benefit at all for them too? Pl. clarify.

  21. Dear Sir, Please see the article dated 01 Aug 2015 in blog "The Voice of Pensioners" which says that the order is not applicable for pre-2006 pensioners having less than 33 years service. Is it true?. Hony Capt Daniel Mathews.

  24. Maj Navdeep, Thanks for updating and informing that it is closure of agony for pre -2006 veterans. This is neglected lot by govt but looked after and given justice by lower to supreme courts, be it maj gen case, rank pay arrears case, many disability case and this case. It seems that in case of OROP, credit will also go to Supreme Court. We very well know you are professionally well qualified in military matters and recently you have been asked to do a important role to give your recommendation. All concerned are looking for a fruitful justified action from your side. Thanks

Dear Ashok Sir, The recent Circular dated 30/07/2015 issued by DOPPW is only extending the applicability of judgement in OA 655/2010 (field in CAT PB by Railway officers who are having more than 33 years of service pleading for Modified parity to pre-2006 pensioners) to applicants other than petitioners in the above case.Hence this Circular have no effect on the pre2006 pensioners who are having less than 33 years of service, thereby, practically not applicable to faujis as hardly any one in fauj completes 33 yrs of service.

    50% pension to less than 33 years of service is a separate case wherein HSC ordered to pay the arrears w.e.f.01/01/2006 with in 4 months. The deadline for compliance of this judgement has expired on 17/07/2015.Now the petitioners need to approach the HSC for contempt of court for non-implementation of court order.

  29. The closure will be full, and final, only if pension parity for Maj with more than 20 years of service and Lt Col with more than 26 years of service is also taken care of in the MOD/PCDA order when issued. http://bit.ly/1SSjYKY.

  30. Dear Navdeep, your services to the ESM is immense. We would like to hear about the current position of the OROP as no others are giving any news or hope about its implementation. At one time you yourself impressed us to be patient with Mr Modi's delay. But things are being stretched too far. We feel that everyone is mocking at us. Will you come out with the current position on OROP.

    I already consult army pension helpline regarding these orders, and they replied that they can't implement it unless Defense Ministry notifications and PCDA circular, so matter is still pending for defense services, kindly comment and reply if i m wrong somewhere.

  37. For some mysterious reason, PCDA have not, till the moment of posting this comment, issued a circular implementing this decision for armed forces pensioners.

    They have been fairly prompt in issuing one for civilian pensioners listed under the heading "Defence Civilians" on this web page http://www.pcdapension.nic.in/6cpc/civilOrder.htm.

    Some prominent blogs and ESM associations, again on inputs from some "keyboard warriors", well meaning though misinformed in this case, continue to circulate, for information of armed forces pensioners, that order which has been listed by PCDA as having been issued for defence civilians. At least a clarification needs to be obtained from PCDA to avoid the possibility of further misguidance.

    I had tried to bring this out in this tweet.

    The orders for ESM are not issued by DESW so far, may take some time. PCDA has issued circular no C- 114 on 14 Aug 15 for civilians only. PCDA will issue circular for ESM after orders are issued by DESW. So do not expect arrears before end October 2015. For more details visit Ex-Swervcemen welfare.
