As regular readers would be aware, the Supreme Court in KC Bajaj’s case had exposed the hollowness of official procedures and
machinations in denying the element of Non-Practicing Allowance (NPA) to
doctors of the Central Government.
The orders of the Supreme Court were finally implemented
by the Department of Pension and Pensioners’ Welfare which issued universal orders for all affected doctors thereby ensuring that litigation by similarly
placed doctors was curbed.
Now, following the same, the Ministry of Defence has also
issued similar orders for similarly placed doctors.

It has taken almost 6 months for the Department of Pension and Pensioners’ Welfare to issue the orders after orders for civilian doctors were issued. Why this delay? I feel Babus of Department of Pension and Pensioners’ Welfare should be suitably penalised and affected armed forces Doctors compensated.

Dear Maj Navdeep. My late father was a Veterinary officer who retired in 1989. He was getting NPA as part of his pension till about 2001, after which the NPA component stopped. Do these orders also have a bearing on his pension/ my mother's family pension? I would be obliged if some clarification could be provided by anyone.

What is the status of the case of Pre 2006 pensioners who have put in 20 yrs of service, in context of the CAT judgement , that they should get full pension not pro-rated.

Dear Sir,
1 Your work is laudable and you are doing great service to Ex Servicemen and pensioners.Please keep it up.
2 You have brought out and educated us on disability pension that the disability pension including service pension is free of Income Tax.So for that matter one may not initiate Income Tax return if there is no additional income.
3 However, for House loan etc many times IT assessment order is asked for. So perforce one has to initiate IT return. How ever there is no such column available to reflect exemption of income tax on disability pension. So How to go about it and which columns to fill up for that matter.
4 The Income Tax officer, his subordinates, CA or tha IT advocates referred to by them are also clueless. Even after showing various ruling letters, IT authorities are not agreeable.
5 Please guide on the subject.

This is with reference to sandeep & Madabushi: All pre 2006 retired pensioners and family pensioners are going to get benefit from this. The benefit is prorata with length of service. It means all with 33 yr of service including weightage will full pension and less that they will get reduced pension proportionatelt ie prorata. There is full pension after 20 yr. Supreme court gave ruling to extend that benefit to pre 2006 pensioners also but govt yet to issue orders in this regard.

My father Late Major Sukumar Talukdar AMC has served in the Army from 1963 to December 1973,he also is a war veteran of 1965 war when he was the RMO with 2/5th GR(FF)during the war he lost his nursing assistant M.L. Bhatt under heavy shelling and downpour while attending the injured (Battle Honour Charwa)in the phillora sialkot sector.
He was released from the Army in 1973 when he was RMO with Punjab Regiment in Meerut , without a pension or any other benefits except one CSD card.
I would be highly grateful to your good-self if my late father can be given his due recognition and benefits as a war veteran of 2 major wars fought by India.

Has this order been implemented ? Has any one received any arrears/payment ?

1.calculation of arrears of NPA of military doctors has been left to the bank clerks ,some of whom have no inkling of it
2.The CDA Pensions Allahabad,having all records would make it much easier to immediately implement it.
3.Tables prepared by banks are to be sent to CDA Pensions for authenticity
4.has 6% interest to be paid on arrears since 01-01-1996
5. I would make a plea to CDA to expedite the matter as early as feasible
