One Rank One Pension (OROP) notified

Salient features of OROP notified today:

Pensions based on live data of 2013 calculated at average of minimum and maximum pensions of individuals who were discharged in the said year. Pensions shall be equalized after every 5 years. 

If any person is in receipt of pension higher than the above amount, that shall stay protected. Pensioners with lower amount shall be upgraded.

Arrears with effect from 01 July 2014, to be paid in four installments but recipients of family pension shall be released arrears in one installment. Gallantry awardees also to be paid in one single installment.

Voluntary retirement clause removed for all past retirees but the negative stipulation shall be imposed on future retirees who opt for premature retirement or discharge at own request from today onwards. This shall apply to those who opt for release under Rule 13(3)1(i)(b),13(3)1(iv) or 16B of the Army Rules 1954 and pari materia rules of the other two services.

Judicial Commission will be constituted to iron out the anomalies which shall submit its report in 6 months.

OROP tables based on 2013 data shall be made available very soon.

What about the retirees who have already opted out for retirement or discharge at own request and are due to retire within a year or less i.e. say Aug 16? Will OROP not be applicable for such personnel?? Kindly throw some light....

Dear Navdeep, is it not unfair that the officers now going on PMR will not get the benefit of OROP ?!! Or is there some catch to it??

Sir, I want to know whether personnel in Navy and Air Force who retire after 15 year and 20 year respective irrespective of the rank (PBOR) comes under premature or it only applys to Army only.

Hi,

Is it legally tenable to exclude the PMR prospectively. People of same batch who retired In Oct 2015 will get OROP but those of same batch retiring in Nov 2015 will not get it ??? Is is possible?

Please clarify if applicability to premature retirees clause implies those exercising option from today or those exercising option for retirement on or after today, irrespective of date when option exercised.

So now if from the same batch someone took PMR in Oct 2015 he will get OROP but his batchmate retiring in Dec 2015 will not get OROP. Is this legally tenable... service conditions of both individuals have to remain same ...????

Compulsive inclination to create rifts and acrimony regarding applicability of OROP for pre mature retirees.Any sense of fair play of its applicability for past pre-mature retirees but not from now on? will it stand judicial scrutiny?

I am confused. After the military pension is adjusted as per OROP (2013 base year), will the 7th pay commission (expected in 2016) further revise it by 2.86 factor as circulated in some forums?

I fail to understand the significance of the base year to the protests against it. As I know, if a colonel with 26 yrs service retired in 2010, another in 2014, both will get the same pension till it is revised in the next pay commission. There is no yearly increment on pension, because if there was the two Cols would get a 3% increment one yr after retirement meaning they served for 27 yrs...which of course is a paradox. So then is the base year the commencement of the 5 yr OROP Plan and nothing else?

The revision of pension will be once in five years. Does it mean that our pension will not be revised with 7th pay commission wef 01/01/2016. Kindly clarify

Finally the govt has issued policy letter on OROP for veterans. It seems that all veterans are dissatisfied with the terms and conditions governing OROP. I am not able to comprehend or understand the reason why the veterans are making big hue and cry about OROP when they are already drawing more residual pension than the veterans who retired after implementation of 6 CPC. The pre 6 CPC veterans who retired upto 31 Dec 2005 may find it odd to stomach this statement. It is the reality on ground. Hence old veterans should be happy about the OROP that has now been announced by GOI. With this the difference of residual pension of old veterans as compared to the veterans retired during the currency of 6 CPC will increase further. The bone of contention of old veterans is that they got very less amount on account of commutation of pension as compared to the veterans of 6 CPC era. It is correct and no doubt about it. But the point what old veterans are conveniently forgetting is that whatever be the amount of commutation it is refundable with interest to GOI over a period of 15 years. Therefore the argument that old veterans got less commutation value is out of placed and not factual as all veterans got to refund whatever amount they got at the time of retirement.
As regards revision of basic pension the time period stipulated now is 5 years instead of 10 years as at present. It is definitely a gain for all veterans. In the back drop of above I being a defence veteran feel that OROP should be accepted without much hue and cry. If defence personnel are getting less pay than the civilian counterparts who is to be blamed?....Nobody else except our self centered and self serving flag officers of the armed forces. Who has stopped AV Sing commission report....Who has stopped higher age for retirement of navy Capt(TS).Who has stopped NPA for doctors in the armed forces... I am glad that SC has now given directives to increase the retirement age of Navy Capt(TS). Had it not for the myopic approach of our flag rank officers of all three forces, pay parity could have been achieved by defense personnel.... Only God or SC can help serving defense personnel or veterans.

GOI letter states that revision, in other words, equalization of basic pension would take place every 5 years. The 7 CPC is around the corner and going by GOI letter armed forces veterans may not get the benefits of 7 CPC from its date of implementation. Instead they would get the benefits only from 2018, the in which next revision is due. Is it correct.

Pension will be equalised every 5 years. Does that mean that benefit of 7th pay commission is not likely to be passed to pensioners.

Does release from service after missing the three boards also fall under voluntary release as defined? (thus not being eligible for OROP)
